1. Agreement to These Terms
By accessing this website, submitting a form, placing an order, accepting a quote, or using our services, you agree to these Terms and any service-specific terms shown during checkout or on your order confirmation. If you place an order for another person or organization, you represent that you have authority to bind that person or organization.
2. Rental Orders, Pricing & Payment
Rental availability, pricing, included weight, rental duration, delivery area, taxes, landfill or environmental charges, and other order details are confirmed at booking. Website prices and availability may change before an order is accepted. Payment is due as stated during checkout or on the invoice.
You authorize Dump Daddy to charge the payment method provided for the initial order and for valid additional charges arising from the rental, including excess weight, extended rental, prohibited materials, dry-run or unsuccessful-trip charges, relocation, damage, cleaning, fines, disposal surcharges, and collection costs when applicable. We may provide documentation supporting an additional charge.
3. Delivery Access & Placement
You grant Dump Daddy and its service providers permission to enter the delivery property. Before delivery, you must disclose hazards and provide safe, unobstructed access with adequate clearance for the truck and container. Hazards include soft ground, septic systems, irrigation, low wires, tree limbs, roof overhangs, narrow drives, slopes, gates, buried utilities, and restricted access.
You are responsible for choosing and approving the placement location and for obtaining permission from the property owner when you do not own the property. Placement on streets, public property, rights-of-way, grass, gravel, pavers, or other nonstandard surfaces may require prior approval and permits.
4. Property Damage & Driveway Protection
We use reasonable care and may use a driveway-protection system when conditions allow. However, dumpsters and service trucks are heavy. To the fullest extent permitted by law, Dump Daddy is not responsible for cracking, sinking, rutting, marking, or other damage to driveways, pavement, curbs, lawns, landscaping, utilities, septic systems, structures, or surfaces resulting from customer-selected placement, undisclosed conditions, insufficient clearance, or ordinary delivery and removal.
5. Customer Care of Equipment
While the container is at the rental location, you are responsible for its proper use and reasonable safekeeping. Do not move, alter, climb on, burn in, vandalize, or allow unauthorized use of the container. You are responsible for loss, theft, contamination, or damage beyond ordinary wear caused while the equipment is in your possession or control.
6. Loading Requirements
- Keep all debris at or below the top rail. Nothing may protrude from the sides or create an unsafe “pincushion” load.
- Distribute weight evenly and do not exceed the included allowance or legal hauling limits.
- Keep the container accessible on the scheduled or requested pickup date.
- Heavy materials—including concrete, brick, rock, soil, dirt, gravel, asphalt, sod, and roofing material—require prior approval and may have separate fill-level and container rules.
- Do not overload the container or load it in a manner that makes transport unsafe or unlawful.
If a container cannot be safely hauled, you must remove or rearrange materials. Additional trip, labor, daily-rental, or unloading charges may apply.
7. Prohibited & Restricted Materials
Never place hazardous, toxic, flammable, explosive, infectious, radioactive, or liquid waste in a container. Prohibited or restricted items include paint, oil and petroleum products, chemicals, batteries, tires, sealed drums, liquids, refrigerants, air-conditioning units, refrigerators, freezers, food waste, railroad ties, and any material prohibited by law or the receiving facility.
Appliances and certain bulky, heavy, or special-handling materials require approval before loading and may carry additional charges. The current guidance on our Prohibited Items page is incorporated into these Terms. If you are unsure about any material, call before placing it in the dumpster.
8. Weight, Disposal & Other Charges
Included weight and excess-weight pricing are stated in your order confirmation. Disposal facilities determine measured weight and may impose surcharges or reject loads. You are responsible for charges caused by excess weight, prohibited or undisclosed materials, special handling, contamination, sorting, governmental fees, or facility charges attributable to your load.
9. Rental Period, Pickup & Unsuccessful Trips
Your rental period is stated in your order confirmation. Extensions require approval, remain subject to availability, and may incur daily charges. Pickup and delivery windows are estimates, not guaranteed appointment times. Same-day service is subject to availability.
An unsuccessful-trip or relocation charge may apply when we cannot complete service because of blocked access, locked gates, vehicles, low clearances, unsafe or overloaded containers, prohibited contents, customer-requested repositioning, or other conditions outside our reasonable control.
10. Cancellations & Refunds
Cancellation and refund eligibility depend on the timing of the request and whether dispatch, delivery, disposal, or other costs have already been incurred. Any cancellation terms shown at checkout or on the order confirmation apply to that order. Contact us promptly if plans change.
11. Permits, Laws & Fines
You are responsible for permits, permissions, association rules, and local restrictions affecting container placement or use. You are also responsible for fines, penalties, towing, or other costs caused by your placement instructions, contents, overloading, or violation of law.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dump Daddy Waste Services, LLC and its owners, employees, contractors, and agents from claims, fines, losses, liabilities, damages, and reasonable legal expenses arising from your breach of these Terms, your use or possession of the equipment, conditions at the service location, or materials placed in the container, except to the extent caused by Dump Daddy’s gross negligence or willful misconduct.
13. Limitation of Liability
To the fullest extent permitted by law, Dump Daddy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, project delays, or loss of use. Our total liability related to a rental or service will not exceed the amount you paid for the specific rental giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.
14. Website Use & Intellectual Property
Website content is provided for general information and may be updated without notice. Dump Daddy’s names, logos, graphics, photographs, copy, and website materials are owned by or licensed to Dump Daddy and may not be reproduced or commercially used without written permission. You may not misuse the website, interfere with its operation, submit false information, or attempt unauthorized access.
15. Electronic Communications & Text Messages
By submitting your contact information, you consent to receive transactional calls, emails, and text messages related to your inquiry, quote, rental, delivery, pickup, billing, and customer service. If you separately opt in to marketing messages, consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of marketing texts and HELP for assistance. Transactional communications necessary to complete an active rental may still be sent as permitted by law.
16. Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.
17. Governing Law & Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes arising from these Terms or our services will be brought in a court of competent jurisdiction serving Gwinnett County, Georgia.
18. Changes, Severability & Entire Agreement
We may revise these Terms by posting an updated version with a new effective date. Changes apply prospectively. If any provision is found unenforceable, the remaining provisions remain effective. These Terms, together with your quote, order confirmation, invoice, and incorporated policies, form the agreement concerning the applicable services.
